• Track team performance and analytics
• Connect multiple email accounts and providers
• Access the Service via web and mobile applications

3. Account Registration and Security

Account Creation

To use the Service, you must create an account. You agree to:

• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you agree to:

• Automatic renewal unless you cancel before the renewal date

Refunds

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELDMAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless WeldMail and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another person or entity.

13. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at legal@weldmail.com to attempt to resolve the dispute informally.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. You waive your right to a jury trial and to participate in class actions.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeldMail regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
